Current Amicus Activity:
Mario Almaraz vs Environmental Recovery Services (a.k.a. Enviroserve); and State Compensation Insurance Fund; Joyce Guzman vs Milpitas Unified School District, Permissibly Self-Insured; and Keenan and Associates, Adjusting Agent - In these two of the three cases involving the AMA Guides relating to determining permanent disability in workers' compensation claims and the intent of SB899 CSIA has filed amicus curiae brief on behalf of California self-insured employers. All three cases have received widespread public notoriety and extensive amicus participation by the California Chamber of Commerce,the California Workers' Compensation Institute (CWCI), and Employers Direct Insurance Company
Recent Amicus Activity:
Jose Facundo-Guerrero vs Nurserymen's Exchange; Insured by Argonaut Insurance Company - In a case that received widespread public notoriety and extensive amicus participation, the 1st Appellate District has issued a surprisingly quick opinion in a legal challenge to the 24 visit cap for specific forms of treatment under Labor Code §4604.5(d). Argued in early May of 2008, the court decisively rejected arguments that the limitation on chiropractic, physical therapy and occupational visits was an unconstitutional limitation on the injured workers right to medical treatment.
